Relocation is a word most couples of divorce don’t like to hear, especially if it involves children. If for whatever reason a custodial parent decides to move away, it can be traumatic for the non-custodial parent, effecting parenting time and other custody arrangements. All matters regarding intrastate custodial parent relocation are referred to the state courts, in which judgments are made looking at the ''best interests'' of the child. In the ''best interests'' of the child, Texas state laws encourage both parents to reside in the same geographical vicinity, with the custodial parent allowing maximum reasonable visitations by the non-custodial parent. In cases where agreement cannot be reached, the burden rests on the custodial parent to convince the court that relocation would greatly benefit them and their children. If the custodial parent relocates more than a hundred miles away from the non-custodial parent’s home, Texas has a statutory enactment that penalizes the relocating parent by requiring the custodial parent to pick up and drop off the child at the non-custodial parent’s home. However, this may not be practical if a non-custodial parent lives a plane ride away. Financial considerations may also complicate matters.
