Father’s rights are an emerging area in family law, taking root in our very own communities. In the past 40 years, there has been a significant shift in parental responsibilities. As the role of women changed in the 1960s and 70s from homemaker to working woman, so too did the role of men as fathers. With time, women became more and more independent, and men started sharing more of the domestic duties, such as cooking, child rearing, etc., until it became an accepted reality that fathers and mothers are equally responsible for their children.

Unfortunately, situations involving a separation or divorce can put a damper on notions of shared responsibility and parenting, often times leading to contentious battles regarding child support, equitable distribution, grandparents rights, relocation and most important of all child custody. According to the latest available statistics, 42 percent of single fathers are divorced and 84 percent of child-support providers are men.

Recent studies also reveal that children without responsible fathers present in their life are more prone to performing poorly in school, engaging in criminal activity, and abusing drugs, alcohol and other substances. In addition, a survey of over 20,000 parents done by the National Center of Education Statistics found that where fathers were involved in their children’s education, children were more likely to enjoy school, get better grades and participate in extracurricular activities.

In certain situations, a father’s rights can be severely violated. Parental alienation or parental alienation syndrome (PAS) is a disorder that has manifested itself from custody disputes. The target is often the non-custodial parent, which in many cases happens to be the father. When one spouse denigrates the other in front of their children with the intent to brainwash, it leads to father-child bonds being tested as the child exhibits negative behavior and resists a relationship with their father.
